"Shocked? This really happened..."

Frankly - I'm not sure what's worse:

The fact that this actually happened,
or where it happened.

This isn't a happy story. I've written it in short-hand so it's a fast read. Here goes:

A Responsibly armed citizen (we'll call him "man") is walking to his truck, and he sees a homeless-looking man with a big dog near the tailgate of his truck.

Man keeps walking. After all, it's his truck.

At about 30 feet away, the dog charges the man. Man shouts "control your dog!". Dog looks ready to kill.

Man pulls concealed GLOCK, shouts again, "Call your dog!". Homeless man says nothing.

Dog is big. Man is afraid for his life. Man feels he has no other option. Man shoots dog twice. Dog stops in his tracks.

Homeless man is now charging at armed citizen screaming that he's 'going to kill him.' Man is again afraid for his life.

Man tries to back up, but the homeless man is running fast. Man raises GLOCK again. Man shouts "Stop or I'll shoot!!"

Homeless man shouts death threats louder as he gets nearer. Man feels he has no other choice. He shoots to defend himself. He fires until the threat is gone. Homeless man dies at the scene.

Man is arrested, public is outraged that he shot a homeless man's dog and then the homeless man. There were no witnesses. It's Man's word against Homeless man's image.

The man is painted to be a trigger-happy murderer long before he ever gets to trial.

Even man's friends wonder why he didn't just "run away".

Man can't afford a good lawyer. Gets public defender. Public defender says he could get life in prison, suggests taking a plea bargain for 12 years.

Man weeps. His family needs him. He is afraid of life behind bars. He doesn't want his kids to grow up without him, but even worse would be to fight the case, lose, and never see them again.

Local newspaper keeps making man seem like a lunatic.

Public defender says he can't win the case. Suggests the 12 year plea bargain again.

Man feels he has no choice. The nasty words in newspaper make him wonder if what he did was right or not.

Man decides to take plea bargain.

This was three hard years ago. Nine more years behind bars to go.

Man's kids are tired of going to prison to visit their father. Man's wife is having a hard time doing it all alone.
