New York City Denies Second Amendment Rights

I live just a few miles from the most pro-gun city in the United States – Kennesaw Georgia – where gun ownership is mandatory. It’s not the “Wild West” like some people predicted when it passed a mandatory gun ownership law. “The city of Kennesaw was selected by Family Circle magazine as one of the nation’s ‘10 best towns for families.’ The award was aimed at identifying the best communities nationally that combine big-city opportunities with suburban charm, a blend of affordable housing, good jobs, top-rated public schools, wide-open spaces, and less stress.”[1]

In 1982 the city passed the following ordinance [Sec 34-21] which was a response to a handgun ban in Morton Grove, Ill.

(a) In order to provide for the emergency management of the city, and further in order to provide for and protect the safety, security and general welfare of the city and its inhabitants, every head of household residing in the city limits is required to maintain a firearm, together with ammunition therefore.

(b) Exempt from the effect of this section are those heads of households who suffer a physical or mental disability which would prohibit them from using such a firearm. Further exempt from the effect of this section are those heads of households who are paupers or who conscientiously oppose maintaining firearms as a result of beliefs or religious doctrine, or persons convicted of a felony.

The city’s website states that Kennesaw “has the lowest crime rate in Cobb County,” one of the most populace counties in Georgia. In fact, from 1982 through 2009, Kennesaw had been nearly murder free with one murder occurring in 2007.

There were three murders in 2010 committed by the same man in what is described as a “school safety zone,” an area extending 1,000 feet from any school, including adult colleges and technical schools. This means that even though Kennesaw has the most liberal gun laws in the United States, employees at the facility where the murders were committed could not have a gun on the premises. Of course, criminals don’t care about laws; that’s why they’re criminals. Ed Stone of Atlanta Gun Rights Examiner makes these important points:

“Unfortunately experience with actual ‘school safety zones’ in Georgia has proven that the ‘school safety zone’ law approach does not stop violent armed crime, as it disarms only the potential victims of an attack. Criminals seeking to rob, rape, and murder ignore the ‘school safety zone’ as merely one more law they are breaking.”

Now we come to New York City. In the past few months, a number of gun incidents have spilled over to the national press. In September 2011 Ryan Jerome, a former Marine Corps gunner, walked up to a security officer at the Empire State Building and asked where he could check his gun.

He had a valid concealed carry permit from his home state of Indiana. He also had the rights given to him under the Second Amendment. No matter, the security officer called police and Jerome spent the next two days in jail. “The 28-year-old with no criminal history now faces a mandatory minimum sentence of three and a half years in prison. If convicted, his sentence could be as high as fifteen years.”

He brought the gun for protection since he was traveling with $15,000 worth of jewelry that he planned to sell. Certainly a rational decision, given the crime rate in New York City and stories like the U.S. Marine veteran who was shot three times when a Craigslist transaction went bad.

In December of 2011, Tennessee nurse Meredith Graves noticed a “no guns” sign at the World Trade Center site in New York City and asked where she could leave her weapon. Like Jerome, she was arrested and faces similar charges. Mayor Bloomberg claims that she was in possession of cocaine. It seems that what the police found was BC Powder, an over-the-counter pain reliever that is sold exclusively in the South.

“Also in December 2011, Tea Party Patriots co-founder Mark Meckler was arrested after attempting to check a pistol — for which he has a California concealed carry permit — at a New York airport.”

Gun deaths have declined in New York City, while killings involving knives have increased 50 percent. The issue isn’t guns or knives but people who use guns and knives. In a 25 year period, New York City has had more than 15,000 murders – 2245 in 1990 alone – while Kennesaw, Georgia, had 1.

Article IV - The States
Section 1 - Each State to Honor all others Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof.

If my marriage license, vehicle registration, drivers license, why not my concealed carry permit? Hopefully a new Conservative Congress and White House will look into this. And besides shouldn’t the Second Amendment be my concealed carry permit?

Seems strange that states will recognize your license to drive from another state, but not your license to carry a weapon? Really? Was there a Federal background check for your driver's license?

I believe the 2nd Amendment states that our right to "Bear Arms" (which includes carrying them on us) Shall NOT be infringed upon.

Odd that NYC never charges this manditory jail time to the criminals or the illegals there. No where in any of the stories have I read what the charge is and how they plan to carry it out? Bloom is a self centered idiot.
This could have never have occurred if we were living under Yahweh's law, which does not provide us with the right to self-defense, but commissions us with the responsibility to defend ourselves and others, as per Psalm 149:6-9, etc.

Many Americans who celebrated Heller overlooked the fact that it can – and likely will – be overturned by a future court, just as its decision overturned United States v. Miller, 307 U.S. 174, rendered in 1939. If you look to the Second Amendment for your authority to bear arms, that authority is contingent upon the fickle nature of nine fallible human beings."

Two States that I would never live in (or Die in) are new York and Illinois. Wonder why? Because you can't defend yourself and every criminal knows it.

A carry permit issued by the State of New york is not valid in the City of New York but a permit issued by the City of New York is valid in the entire State Of New York. Since the City does not honor N.Y. State pistol license's maybe they should issue their own drivers license as well , and valid only in the cities boundries

New York should be sued just like Washington D.C. was. It is so hard to get a pistol permit for NY and they don't respect permits' from other states. When you outlaw guns only outlaws will have them

I am a strong supporter of our 2nd ammendment rights, served in the USMC, have a carry permit and carry wherever I travel.

However, although I strongly disagree with the gun laws of NYC and particularly with Mayor Blumberg, I will not admit to carrying in New York. That state has some of the strictest gun laws and you have to be foolish to carry there much less be so naive as to admit it to the local LEO's.

Until the law is changed, don't deliberately break it and then cry about the punishment for doing so. Each state has it's restrictions and if you disregard them, then pay the price of your ignorance.

Your are dealing with stupid liberals in New york City, what do you expect. In NY if someone comes into your house that doesn't belong there instead of defending yourself, the liberal politicians say for you to leave your home find a safe place and call police. I bet that so call politicians have guns to protect themselves or cops are with them at all times. No one should have to retreat from there home if a bad guy comes in unless that is what you want to do. I live in Florida now and I have a conceal weapon permit and in this state you do not have to retreat from your home if a bad guy comes in. You can defend yourself. I go to NY and do bring a weapon with me, I have to hide it, what a joke. The 2nd amendment is for all America.

To begin with NYC, IS a human zoo. From there, however, now reside in NH. One of the better moves I have ever made. Been here for just under a quarter century. Our 2nd ammendment guarantees the Right To Bear Arms. No matter what state we are in.

Bloomberg I am ashamed to say he is Jewish, but I guess if every Jewish person was normal then we as Jews would have to point the finger at someone is not Jewish (not a good thing!). I have met him and he is proud and arrogant and will do anything to support the Democrat agenda. The BC powder is so typical or and by the way New York's finest are nothing to be proud of ! Between them and the criminals is many times no more than there GPS coordinates.
New York is the number one prejudice city in the United States. I studied in New York for a while and all I had to do was to say in my Southern draw "Good Morning! How are you doing/" and I would be met with a cold shoulder. I was even taken to the police for being attacked by a mugger and defending myself! I broke four of his ribs and he had to have 26 staples in his head. They wanted to nail me with 2nd degree assault by way of using excessive force. When the Judge ask me how and why did I bust his head up! I simply told him I did not have any thing to do with the choice of brick texture on the building, and if he had stopped fighting after I took his knife away there would have been no problem! His accomplish had a gun but that was of no interest to the Police. I stated to the Court if you have one person trying to stab you and the other holding a gun on you, well then you don't stop until at least one is one the ground and I would have broken four more ribs if that is what it took to get out of danger! My attacker went to Jail for robbery in New Jersey so eventually my case was dismissed. That is New York!

Michael Bloomberg supports and uses Nazi anti gun laws on decent citizens.
No wonder democrats seem so determined to rid us of the Constitution. They keep digging away at it year after year. Wakeup Americans! Santorum has ignored answering how he feels about gun control and attacks Ron Paul because he believes in the Second amendment, and he is not even a democrat. Yikes.

Sounds like the only ones allowed to carry guns in New York are the criminals. People from other states who are not criminals are not going to go up to a police official and ask where they can check their guns. The criminals will just go out shoot and rob someone and no one will notice until the crime has been committed. Maybe they should keep a closer eye on their drug dealers and boys in the hood and leave the respectable people alone. Maybe some of these city slickers need to come down south, go walking around in the woods where the rattlesnakes and water moccasins roam about and even a group of hungry coyote, or rabid fox or go a little farther down and have wild hogs chase you up a tree, or a lost alligator get on your trail and see who needs a gun. Bet there wouldn't be any discussion on who needs a gun then!
I get really depressed when I read stories like this. Our rights are being eroded slowly but continually till we will have none at all. The 2nd amendment is not just for personal protection but also to help us keep the government in line. Read all the supreme court decisions.
A WELL REGULATED MILITIA BEING NECESSARY TO THE SECURITY OF A FREE STATE,THE RIGHT OF THE PEOPLE TO KEEP AND BEAR ARMS, SHALL NOT BE INFRINGED.
