Dear Jack,

As we predicted, Big Labor has launched a legal attack aimed at destroying Indiana's newly-enacted Right to Work law -- an attack that is in fact a dagger directed against virtually every state Right to Work law.

Anticipating this development, earlier this month your Foundation launched a special legal task force aimed at protecting Indiana's popular Right to Work law and determined that it is on sound legal ground.

Foundation attorneys have successfully defended state Right to Work laws in the past and are confident of prevailing again -- but the Big Labor bosses are desperate to keep their forced-dues cash piling in.

On Wednesday, International Union of Operating Engineers Local 150 union lawyers filed a federal lawsuit to block the Indiana Right to Work bill.

Incredibly, union lawyers contend that Indiana's Right to Work law is "preempted" by the National Labor Relations Act -- even though federal labor law specifically affirms the right of states to enact Right to Work laws.

Moreover, in the Foundation-won Davenport v. Washington Education Association (2007), the United States Supreme Court reiterated that, as the Court had originally decided in 1949, Right to Work laws are constitutional.

Foundation attorneys are fully prepared to defend the law from this spurious assault and have been approached by workers in Indiana who are interested in joining this crucial battle to protect worker freedom in Indiana.

In a similar case, Foundation attorneys are providing free legal aid to civil servants who filed an amicus brief and a motion to intervene against union lawyers' lawsuit seeking to overturn Wisconsin's government-sector Right to Work law.

You see, the Foundation must guard against union-boss legal challenges that could jeopardize Right to Work laws nationwide.

Union bosses know that for decades the courts have upheld Right to Work laws while acknowledging the fundamental conflict between compulsory unionism and freedom of association.

But as the Obama Administration's appointments add up in the federal judiciary, they hope this may change in the years it could take for this suit to hit the U.S. Supreme Court.

And also they intend that the lawsuits -- real and threatened -- will stall the growing Right to Work movement in other states like New Hampshire and Montana.

Big Labor wants to frighten legislators nationwide by showing them how hard and costly a battle like the ones raging in Wisconsin and Indiana can be.

Defending the 23 state Right to Work laws is a crucial component of the National Right to Work Foundation's strategic litigation program made possible by the generosity of Right to Work supporters like you.

Union lawyers hope to bleed us dry by filing groundless lawsuits against Right to Work laws to keep the Foundation from going on offense and bringing cases against forced-unionism schemes for victimized employees.
