Either the Constitution is as valid today as it has been throughout our nation’s history – or, as some believe, it is a malleable document subject to interpretation reflecting the social morays of the day. The Supreme Court hearings on ObamaCare turned today to the “individual mandate.” The Justices’ ultimate ruling on this matter will indicate how the Constitution is viewed by this Court.
I am more convinced than ever that we MUST intensely pray for the Supreme Court – and to be delivered from the anti-life, anti-liberty ObamaCare law! I have recorded the second of a special series of audio message for you outlining the Supreme Court’s activity today and my thoughts on what transpired. Tuesday’s Court hearing was centered on the “individual mandate,” which is the core question facing the Court: Does Congress have the constitutional authority to require individuals to purchase and maintain a minimum level of health insurance or force them to pay a penalty if they chose not to do so?
As a constitutional attorney who has argued before the Supreme Court, and having spent countless hours in the litigation process against ObamaCare, I firmly believe that the mandates forcing individuals and employers to obtain or provide government-defined health insurance are patently unconstitutional.
At the heart of today’s debate was “the Commerce Clause.” In Article I, Section 8, of the Constitution, under the powers specifically given to Congress, is this language: “To regulate Commerce with Foreign nations, and among the several States...”
Today’s discussion seemed to polarize the Justices! In fact, much of what is being argued in this historic case is predicated on two distinct schools of thought…
First, that under the Commerce Clause, Congress has the power to regulate interstate commerce. ObamaCare supporters use that premise to conclude that the Court should uphold the “individual mandate” of ObamaCare as a permissible regulatory action of certain commercial transactions.
Second, opponents of ObamaCare argue that although Congress has been granted that power, ObamaCare oversteps the boundaries and exceeds Constitutional authority in that it FORCES individuals to participate in a commercial activity. ++As Justice Anthony Kennedy asked, “Are there any limits?”
Remember, the Constitution was crafted to define the separation of government branches – and to impose strict limits on government power.
As I wrote in my book Take Back America, Congress does not have unlimited authority to regulate private actions. If the Constitution does not give Congress the power to act, then Congress cannot act. Congress clearly lacks the constitutional authority to force individual to have – or businesses to provide – health insurance.
Congress’ attempt to force health insurance coverage on the nation is a stunning example of what Congress cannot do under the Constitution of the United States of America! ++Under the Constitution, is the Supreme Court the supreme authority?
Here is another reason why our nation hangs in the balance – and why we must be in prayer for the Supreme Court Justices...
It is a tragic fact that the biggest destroyer of American values and religious freedom in this country over the years has been the United States Supreme Court! We, the governed, have allowed the Supreme Court to amass power it was never granted. Unchecked by the people, the Supreme Court has turned its powerful cannons on religion (for instance, the public display of the Ten Commandments)… and the public schools (prayer in schools)… and abortion (Roe v. Wade).
Time will now tell how they will rule on our very personal healthcare matters… and what we are required to purchase… and what immoral services we will be forced to provide to others under ObamaCare!
These are just a few of the reasons why I am calling for ALL Liberty Counsel team members to commit to PRAY! And after listening to today’s debate at the Supreme Court, I am convinced that this decision is going to be VERY CLOSE. As you will hear in my audio report on today’s activity, the “individual mandate” debate was quite polarizing. It seemed from the Justices’ questions that the four reliably “liberal” Justices seemed very supportive of the government’s right to issue just such a mandate as the one at the heart of ObamaCare.

++Prayer is the key to victory in this struggle against tyranny.
Not only will ObamaCare destroy our precious freedom, it will bankrupt our nation, and result in killing millions of unborn children through massive abortion funding. I cannot think of a more important occasion for a national outcry to the Lord!
When tens of thousands of believers are united in prayer, the resonating cry of “Lord, Deliver us from ObamaCare,” will be heard throughout our land…and the Lord promises He will be moved!
