Gingrich: Send U.S. Marshals to Arrest Activist Judges

Former House speaker Newt Gingrich showed no sign Sunday of letting up on his assault on “activist” federal judges. During an appearance on CBS’s “Face the Nation,” Gingrich suggested the president could send federal law enforcement authorities to arrest judges who make controversial rulings in order to compel them to justify their decisions before congressional hearings.

When asked by host Bob Schieffer how he would force federal judges to comply with congressional subpoenas, Gingrich said he would send the U.S. Capitol Police or U.S. Marshals to arrest the judges and force them to testify.

Gingrich, who in recent weeks has surged to the front of the pack in the race for the 2012 Republican presidential nomination, has come under fire from the left and the right for his attacks on the federal judiciary. Michael Mukasey, former attorney general during the George W. Bush administration, said some of Gingrich’s proposals were “dangerous, ridiculous, totally irresponsible, outrageous, off-the-wall and would reduce the entire judicial system to a spectacle.”

The man isn't saying jail them, so what is the problem? He is only saying that he would force them to appear and testify when subpoenaed. That is no less than would be done to any citizen; if subpoenaed we would have to appear or be escorted by officers of the court. It is about time someone is willing to hold these nuts accountable for rulings of questionable constitutionality!

He is, at least, addressing a subject that has been overlooked by the other candidates. Just like Gov. Perry's idea about a part time Congress. It does work well here in TX, and I'm glad to hear anyone's ideas about reducing the size of this enormous and increasingly restrictive government. I will support whomever gets the nomination, because any one of them will be a vast improvement over the chucklehead in charge right now.

Wow many of you liked what Tony said but have I missed something. Was there a Tony I missed in the article. Sometimes the mobile version doesn't give the whole article and no link to view the rest. I would hope that Tony wasn't a comment participant because if so then the moderators deleted his comments. This site does that and it is somewhat scary. Maybe a plant to keep an eye on us crazy right wingers?

As often is the case, the headline author misdirects and wrongly twists the thought process regarding WHY Newt said what he said.
RE-read Schieffer's question: It was: What do you do if judges "fail to comply with Congressional subpoenas?" Newt's answer to the ACTUAL question is logical and meaningful.
THE REAL SPECTACLES ARE THE INCESSANT LUDICROUS ACTIONS OF THE ACTIVIST JUDGES THEMSELVES.

Activist judges have already made a spectacle of themselves.
Are there any conservative activist judges, who attempt to make policy from the bench? No, because they follow the constitution.

The entire judicial system is already a spectacle. When sorting out clutter, we usually have to make somewhat of a mess to get things back in order.

Gingrich is raising an important issue that shows his wisdom and leadership by not stopping his views because they are controversial. I applaud him!

It is the right of the people to remove judges who do not do their job. When you put people into place, appoint them, and allow them to think they can do whatever they want to without consent, you get corruption. Newt is simply suggesting we grab this monster by the horns, and stop the bleeding. We have gone too long, as cowards, and not done anything about it. We have all alone this country to fall. Any judge that does not strictly interpret the constitution, needs to be removed. Those who think the laws can be bent, to their agenda, need to be removed.

While they're at it, send U.S. Marshalls to arrest the Kenyan on felony fraud charges for holding the office of POTUS illegally.

REALLY?!

Love the misleading headline. What he did say was that the judges should appear in front of Congress. Then asked if they did not show up, what would he do, and he said you can send the marshals to pick them up.

Very misleading title; one I would expect from a liberal website!

This would be a dictatorial shift in power! Maybe you want Newt to arrest "activist" Federal Judges, but would you want Obama arresting Federal Judges? If the President could arrest judges, then ponder, Who couldn't the president arrest and for what? Executive power is too much now, and Newt wants even more. Newt is a "Buyer BEWARE" candidate!
Newt just envisions himself as a better World Dictator than Obama. No man is above corruption, this absolute power of being able to "ARREST" anyone ON IDEOLOGY ALONE is very dangerous!

Judges should be making their decisions using the Constitution not their political agenda. The radical judges have either been voted in or put into their jobs by Washington, It is up to the American People to vote and remove the judges that do not comply with the Constitution and/or to remove the individuals in the House that also do not comply!

Start at the TOP ..as Tony said. Numeral Uno: CIC ..what 'right' have you to deny "We The PEOPLE" [even if only ONE] evidence/documentation that you have "eligibility" to be in the Oval Office? The fact SC/C/SS ..NONE have enforced our Constitution says that unless "We The PEOPLE" ACT ..'our' Constitution is no more. Another Camelot in the abyss of history.
