Mathew Staver, Founder and Chairman 11/30/2011 Monday, we learned that Judge Robert Wiggins favored our position and dealt a major setback to New York Governor Andrew Cuomo and New York City Mayor Michael Bloomberg in the lawsuit we filed against New York’s recently adopted same-sex “marriage” law. Meanwhile, Liberty Counsel remains among the most directly involved public interest law firms fighting to defeat and defund ObamaCare. Please read see my important update below – Mat. Jack, It is a real joy to share encouraging news from the front lines of the “culture war,” especially because the battle has grown so intense in recent months! ++Politicians who break the law must be held accountable. The legal issue: New York law requires that a bill be printed and in its final form on the desks of the legislators three days prior to a vote, unless an emergency exists. Governor Cuomo ignored the provision and declared an “emergency,” stating that waiting three days would deprive same-sex couples of the benefits of marriage! We challenged Andrew Cuomo’s outrageous tactics in completely sidestepping the New York “Open Meetings Law.” After our filing, the state asked the court to dismiss our case. But Monday afternoon, Judge Wiggins sided with Liberty Counsel, ruling that the case may proceed to trial. Liberty Counsel represents New Yorkers for Constitutional Freedoms and several other plaintiffs. The Judge’s ruling is a victory for the people of New York and a setback to the political arm-twisters who tried to get around the rules governing the legislative process. If this sounds like a familiar scenario, it’s probably because we have watched the Obama administration run roughshod over congressional rules to force its will on the American people for nearly three years now (see my report on ObamaCare below)! When government operates in secret and freezes out the very people it is supposed to represent, the entire system fails. New York’s same-sex marriage law should now be set aside and the process should begin again to allow the people a voice in the process. Judge Wiggins wrote, “clear arm-twisting by the Executive on the Legislative permeates this entire process.” The best news: We have a strong case to have this immoral law stricken from the state’s statutes and will now have the opportunity to do just that! We must STOP any momentum and traction pro-homosexual groups hope to achieve in court by being unchallenged (and possibly even assisted) by the Department of Justice! I promise you, Liberty Counsel will NEVER stand silently by as the Obama administration, activist judges, and radical pro-homosexual groups attack marriage and the American family! Because the Court decided to hold our case, neither accepting nor rejecting our petition to be heard, we remain on the Supreme Court’s docket. After hearing the Florida case, which 26 other states joined along with the Nation Federation of Independent Business (NFIB), the Court will address our case. For now, we are preparing an extensive brief to the Court on a wide range of issues. Our Amicus Brief will be a significant factor in helping shape the Justices’ view of the facts. This showdown over ObamaCare is without doubt the most important case the Court will hear in this term and perhaps for many, many years to come.
